eskiin Story Submission Terms

 

1. What these terms cover

These terms apply when you share a story, photo, or video with eskiin through our Tell Us Your Story page or any other story request we send you. We call what you send us your "Submission."

When you check the consent box and submit, you agree to these terms.

These terms are part of our Terms of Service. Where these terms and Section 9 of the Terms of Service say different things about story submissions, these terms control. Everything else in the Terms of Service still applies, including Section 22, which sets out how disputes between you and eskiin are resolved.

In these terms, "eskiin," "we," "us," and "our" mean eskiin Inc.

2. Who can submit

You must be 18 or older. Our site is not intended for anyone under 18, and we do not knowingly collect personal information from children.

If you work for eskiin, or you are a contractor, agency partner, or a family member of someone who does, you can still submit a story. Tell us in your submission so we can disclose that connection if we ever share it. The FTC requires us to.

3. The permission you are giving us

When you submit your story, you are giving eskiin permission to share it. Here is exactly what that means.

You give us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, transferable, and sublicensable right to use, copy, display, perform, reproduce, adapt, edit, excerpt, translate, publish, and distribute your Submission, in whole or in part, in any media now known or later developed. That includes our website, email, text messages, social media, paid advertising, packaging, retail displays, press, and partner channels.

This permission covers anything in your Submission, including your written story, your photos and video, your voice, and any images of you that appear in what you send.

You are not selling us your story. You keep ownership of everything you send. You are giving us permission to use it, and you can keep using and sharing it yourself however you like.

We may combine your Submission with other content, add captions or graphics, shorten it, or use a short quote from it on its own. We will not edit your words in a way that changes what you were saying.

You will not be paid anything beyond the store credit described in Section 7, and you will not have approval rights over how a Submission is used.

4. How we will identify you

If we share your Submission, we will identify you by your first name and, at most, your city or state. For example: "Sarah, Denver, CO."

We will never publish your last name, email address, phone number, or mailing address.

If you would rather we use a different first name or no name at all, tell us in your submission and we will honor it.

5. What you are promising us

By submitting, you confirm all of the following:

• Your Submission is your own work, or you have the right to give us the permission in Section 3.
• Your story is true and describes your actual experience with eskiin.
• Everyone who appears or is identifiable in your photos or video has agreed to appear and to let eskiin use the content this way.
• If a child appears in your Submission, you are that child's parent or legal guardian and you are giving permission on their behalf.
• Your Submission does not include music, artwork, footage, logos, or other material belonging to someone else.
• Your Submission does not include anything unlawful, defamatory, obscene, or that violates anyone's privacy or other rights.
• You are not under any other agreement that would prevent you from giving us this permission.

If any of this turns out not to be true, we may stop using your Submission and ask for the store credit back.

6. We may not use your Submission

We read every story, but we are not obligated to publish or use any Submission. Most will never appear in our marketing. You still get the store credit either way.

7. The $20 store credit

Your story does not have to be positive. The credit is our thank-you for taking the time to share your experience, whatever that experience was. We are not paying for praise, and we will not withhold the credit because we did not like what you wrote.

How the credit works:

• We email it to the address you give us after you submit your story.
• It is good on any full showerhead purchase, including the Handheld and the Wall Mount.
• It stacks with the subscription offer running on our site.
• It does not apply to filters, parts, or accessories.
• It does not expire.
• It has no cash value and cannot be redeemed for cash, refunded, or transferred.
• One credit per person and per household.

We may decline to issue a credit for a submission that is empty, duplicated, automated, or plainly not a genuine account of your experience.

8. We will disclose the credit

Because you receive store credit for sharing your story, the Federal Trade Commission treats your Submission as a compensated endorsement if we use it in advertising.

So when we run a Submission as an ad or a testimonial, we will disclose clearly and near the content that the person received eskiin store credit for sharing their story. You do not have to do anything. We handle it.

9. Personal and health details

People often tell us about skin, hair, or other personal things when they share why eskiin mattered to them. Share only what you are comfortable having other people read.

If your Submission includes health-related details and we use it, we will only share what is needed to tell your story, and we will not present your experience as a medical claim about what our products do. Your experience is yours. It is not a promise of what anyone else will experience.

We handle everything you send us under our Privacy Policy.

10. If you change your mind

Email us at support@eskiin.com and we will stop using your Submission going forward in the channels we control. We will take it down from our website, our email and text programs, and our own social accounts, and we will stop running it in new advertising. We aim to do this within 30 days.

We want to be straight with you about the limits. We cannot recall printed materials already in circulation, pull content that other people have shared or reposted, or undo advertising already delivered. That is why the permission in Section 3 is written as irrevocable. But if you ask us to stop, we stop.

11. Privacy and how we contact you

We collect your name, email address, and phone number so we can send your store credit and reach you about your story if we have questions. We may contact you about your Submission at any time.

When you submit your story, you are also signed up for eskiin marketing emails. You can unsubscribe from any email, at any time, and unsubscribing has no effect on your store credit or your Submission.

We do not sign you up for text messages through this form.

Everything here is handled under our Privacy Policy.

12. Changes to these terms

We may update these terms by posting a new version on this page. The version in effect when you submitted your story is the one that governs your Submission.

13. Governing law and disputes

These terms are governed by the laws of the State of Delaware, without regard to its conflict of law principles, consistent with Section 18 of our Terms of Service.

Any dispute between you and eskiin relating to your Submission or to these terms is resolved under Section 22 of our Terms of Service (Dispute Resolution; Binding Arbitration; Class Action Waiver). That section requires individual binding arbitration, waives class actions and jury trials, requires a sixty (60) day informal resolution period before arbitration may begin, and gives you thirty (30) days to opt out. Please read it before you submit.
