eskiin Refer & Earn Program
1. Program overview and enrollment
The eskiin Refer & Earn Program (the "Program") is offered by eskiin Inc., a Delaware corporation with its principal place of business at 9450 Southwest Gemini Drive, Beaverton, Oregon 97008 ("eskiin," "we," "us"). The Program rewards participants ("Participants," "you") who refer new customers to eskiin, as described in these Terms & Conditions (these "Terms").
The Program is administered on our behalf by Social Snowball, Ltd. ("Social Snowball"), which provides referral links, codes, tracking, and the Participant dashboard, and rewards are disbursed through Tremendous LLC ("Tremendous"). Your use of the Social Snowball dashboard and your redemption of rewards through Tremendous are also subject to those providers’ own terms and privacy policies, which you should review.
These Terms govern the Program and, for all Program matters, take precedence over our general Terms of Service and over any summary of the Program on our website or in our emails, except that disputes are resolved under Section 22 of the Terms of Service as provided in Section 19 below. Except as modified by these Terms, the Terms of Service (including its disclaimers and limitations) and our Privacy Policy also apply to your participation and are incorporated by reference.
Everyone joins the Program the same way: through the signup form on the Refer and Earn page at eskiin.com. If you have purchased from eskiin, we may invite you to join by email after your purchase; the invitation links to the same page. You do not need to have purchased anything to join.
Enrollment is a two-step flow on that page. Step one: review these Terms and confirm your acceptance, including that you are 18 or older and a U.S. resident. Step two: complete the signup form with your first and last name, email address, and mailing address. Your unique referral link is issued only after you have accepted these Terms and submitted the form. We keep a record of the version of these Terms you accepted and when. If you enrolled in an earlier version of the program before these Terms were published, you must re-accept these Terms (for example, in your Social Snowball dashboard) before any further reward is approved or paid.
2. Changes to these Terms and the Program
We may modify these Terms, or modify, suspend, or discontinue the Program, at any time. Changes take effect when the updated Terms are posted, and apply to referrals occurring after the posting date. For material changes, we will require re-acceptance before releasing further payouts. Rewards you have already validly earned under the prior version will be honored under that version.
3. Eligibility
To participate you must: (a) be at least 18 years old; (b) be a legal resident of the United States; (c) participate as an individual (businesses, coupon or deal sites, lead-generation services, and other commercial entities are not eligible); (d) have or create the accounts needed to receive payment through Tremendous; and (e) where we require it, provide accurate tax documentation (Section 8).
We use enrollment information, including your mailing address, to administer the Program and to verify that rewards are not paid on orders shipped to a Participant’s own address (see Sections 9 and 10).
The following are not eligible to participate or to be counted as Referred Customers: eskiin employees, contractors, and agents; members of their Immediate Family or Household; and any person or entity we have previously terminated from the Program. "Immediate Family" means spouse or domestic partner, parents, step-parents, grandparents, children, step-children, grandchildren, and siblings, in each case including in-law and adoptive relationships. "Household" means people who share the same residence at least three months of the year, whether or not related.
One Program account per person. Creating or operating multiple accounts is grounds for termination and forfeiture.
4. Referral links and attribution
When you enroll, Social Snowball issues you a unique referral link (also called your affiliate link). Share the link, not a standalone code. When a friend clicks your link, a unique discount code is generated for that friend to apply at checkout.
- One code per order. Only one referral or discount code may be applied to an order, and referral codes may not be combined or stacked with other discounts, offers, or promotions.
- The applied code wins. If more than one Participant could claim a referral, the reward goes to the Participant whose code was actually applied to the order at checkout. There are no retroactive attributions and no manual credits.
- Referrals count only through the site. Purchases made by phone, chat, email, marketplaces (including Amazon), or retail do not qualify, and referrals cannot be added to an order after it is placed.
5. Qualifying Purchases and the friend offer
You earn a reward only for a "Qualifying Purchase", which means a purchase that meets all of the following:
- It is a purchase of an eskiin showerhead product (one-time or the first order of a showerhead subscription) made on eskiin.com. Filters, filter subscriptions, replacement-filter orders, gift cards, wholesale orders, and add-on charges such as Shipping Protection and Clean Water Club do not qualify.
- It is made by a "Referred Customer", meaning a person who (a) is not you; (b) is not in your Household; (c) has not previously purchased an eskiin showerhead from us (a person whose only prior purchases were filters or gift cards may still qualify); and (d) completes the purchase using the unique code generated from your referral link, in the same session initiated by clicking your link.
- The order is completed, paid, and delivered, and is not canceled, refunded, returned, charged back, fraudulent, or a duplicate.
- One reward per Referred Customer. A given Referred Customer can generate one reward, once, for one Participant, regardless of how many orders they later place.
The Referred Customer receives the friend offer stated on the Refer and Earn page (currently 25% off), subject to that offer’s own conditions. Referral codes cannot be combined with any other discount, offer, or promotion.
6. Rewards and payment
The reward is $50 (USD) per Qualifying Purchase. There is currently no fixed limit on the number of rewards you may earn; however, high referral volume is subject to the verification, fraud-review, and tax-documentation provisions of these Terms, and we may review unusual activity before approving payouts.
- Holding period. Each reward is held for 60 days after delivery of the Referred Customer’s order. If the order is canceled, returned, refunded, or charged back during the hold, or fails verification, the reward is not paid.
- Payment. Approved rewards are paid through Tremendous within 30 days after the holding period clears, with no minimum payout threshold, provided you have accepted these Terms and provided any required tax documentation. You must redeem payouts in accordance with Tremendous’s procedures; payouts unclaimed 12 months after issuance may be forfeited to the extent permitted by law.
- No vesting. A reward is not earned, vested, or payable until it has been verified, has cleared the holding period, and is approved. Pending or estimated amounts shown in any dashboard are not a promise of payment.
- No guarantee. We make no representation that you will earn any particular amount, or anything at all, from participation.
7. Required disclosures
Because you can be paid for referrals, you have a material connection to eskiin that must be clearly and conspicuously disclosed whenever you promote eskiin or share your link. This is required by the Federal Trade Commission’s Endorsement Guides (16 C.F.R. Part 255), and it is a condition of participation.
- On social media: include #eskiinpartner and #ad in the post itself (not behind a "more" break), and tag @eskiin where the platform allows. Use the platform’s built-in paid-partnership disclosure tools where available.
- In video or audio: state the relationship verbally AND include the written disclosure in the caption or on screen.
- Person to person: when you share your link directly with someone by text, DM, email, or in person, tell them you will receive a reward if they buy. You do not need to state the amount. Our default share messages include this disclosure; if you write your own message, you must include it yourself.
- Everywhere: the disclosure must be unavoidable and understandable, before the click rather than after it.
We may monitor Program activity, require you to correct or remove non-compliant content, and withhold or reverse rewards attributable to non-compliant promotion.
8. Taxes and tax documentation
Rewards are taxable income to you. Cumulative payouts are tracked through our service providers. When your rewards approach or reach an applicable federal or state information-reporting threshold (currently $2,000 in a calendar year for federal Form 1099 reporting; some states use lower thresholds), you will be required to provide a completed IRS Form W-9 through Tremendous (or as we otherwise direct) before further payouts are released, and we (or our service providers) may withhold payouts until valid tax documentation is received.
We (or the applicable payer of record) may file information returns (including Form 1099) reflecting amounts paid to you, and may withhold where required by law. You are solely responsible for all taxes on your rewards, and you will indemnify eskiin for any taxes, penalties, or interest arising from your failure to report or pay them.
9. Prohibited activities
The Program is for personal, organic sharing: your own social channels, your own content, and people you communicate with directly. The following are prohibited, and rewards generated through them will be denied, reversed, or recovered:
- Paid advertising of any kind, including search, social, display, native, and influencer placements promoting your link;
- Bidding on "eskiin" or confusingly similar terms in any search or advertising platform, or using "eskiin" in domain names, handles, or account names;
- Posting your link or codes to coupon, deal, voucher, or cashback sites or browser extensions, or to any site whose purpose is aggregating discounts;
- Bulk, automated, or purchased-list distribution of any kind, including mass email, mass texting, robocalls, comment spam, and forum spam;
- Sending commercial email or text messages that violate the CAN-SPAM Act, the Telephone Consumer Protection Act, or any state analogue (you are the sender of messages you originate; see Section 10);
- Self-referral: using your own link or code, directly or indirectly, including through another account, a Household member, or a reshipment address (a referred order shipped to your own address, or to an address associated with your account, is treated as a self-referral);
- Misrepresenting the offer, the product, your relationship with eskiin, or posing as eskiin; link masking or cloaking; incentivizing clicks or purchases with anything of value you offer;
- Creating multiple accounts, using fake or scraped identities or emails, using bots, or circumventing any Program limit or fraud control;
- Any unlawful conduct, and anything prohibited by Section 12 of the Terms of Service.
10. Personal sharing, privacy, and fraud prevention
When you share your link with a specific person, you represent and warrant that you have a personal relationship with that person and their consent to contact them, and that providing any of their contact information to us or our service providers is lawful. Messages you send are sent by you, not by eskiin, and you are solely responsible for them.
We collect and process information about Participants, referral activity, and Referred Customers as described in our Privacy Policy, including through Social Snowball and Tremendous. To prevent fraud and self-referral, we use signals including email addresses, IP addresses, device identifiers, and mailing and shipping addresses (including comparing a referred order’s shipping address against Participant addresses), and we may decline, hold, or reverse rewards based on them.
11. Content standards
If you create content promoting eskiin, it must be truthful, your own genuine opinion and experience, and consistent with these standards:
- No health claims. Do not make claims that eskiin products treat, cure, prevent, or mitigate any disease or medical condition (for example eczema, acne, or hair loss), and do not give health or medical advice. You may describe your own experience honestly.
- Be truthful. Everything you say about eskiin products must be true, not misleading, and based on your own genuine experience or information we have published. Do not invent statistics, test results, or product facts, exaggerate what the product does, or present someone else’s experience as your own.
- No fake or undisclosed insider reviews. Do not write or procure reviews that misrepresent the reviewer’s identity or experience. If you post a review anywhere while participating in the Program, you must disclose your participation. (See the FTC Rule on Consumer Reviews and Testimonials, 16 C.F.R. Part 465.)
- Adverse events. If anyone tells you, in comments, replies, or messages, that they experienced an undesirable health effect they associate with an eskiin product, promptly forward it to support@eskiin.com.
12. Content ownership, license, and takedown
You retain ownership of the content you create. By participating in the Program, you grant eskiin and its affiliates a perpetual, irrevocable, worldwide, non-exclusive, royalty-free, fully transferable and sublicensable license to use, reproduce, modify, adapt, edit, publish, translate, distribute, publicly perform and display, and create derivative works from any content you create or share in connection with the Program (including posts, photos, videos, reviews, and testimonials that feature eskiin products, your referral link, or your Program participation) in any media now known or later developed, for any purpose, including advertising and paid media, without further notice, approval, or compensation to you or any third party.
You represent and warrant that you own or control all rights in your content and that it does not infringe or violate the rights of any third party, including copyright (music included), trademark, privacy, and publicity rights of any person appearing in it, and that you have any releases needed.
Takedown. If we notify you that any of your Program content must be removed or edited (for example, because it makes non-compliant claims, lacks required disclosures, or raises brand or legal concerns), you must remove or edit it within 24 hours of our notice. This obligation and the license above survive termination of your participation.
13. Verification, reversals, and recovery
All referrals, rewards, and payouts are subject to verification. We may deny, hold, or reverse any reward that we determine, in our reasonable discretion, resulted from a non-Qualifying Purchase, a prohibited activity, an error, or fraud. If a reward has already been paid and is later determined to have been invalid or obtained in breach of these Terms, we may recover it, including by offsetting it against future payouts and by direct demand, and you agree to repay such amounts. Our decisions on Program qualification, attribution, and payment, applied consistently with these Terms, are final.
14. Suspension and termination
You may leave the Program at any time by notifying us or deactivating your account. We may suspend or terminate your participation, or the Program itself, at any time.
- Termination for breach or fraud: all pending and unpaid rewards are forfeited, and Section 13 recovery rights apply.
- Termination for convenience or Program discontinuation: rewards already validly earned and verified (including those still in the holding period that subsequently clear) will be paid in the ordinary course.
Sections 8 and 12 through 21 survive termination.
15. Independent contractor relationship
You participate as an independent contractor. Nothing in these Terms creates an employment, agency, partnership, joint venture, or franchise relationship. You have no authority to bind eskiin, make commitments for it, or speak on its behalf.
16. Disclaimers
The Program, the Social Snowball dashboard, and Tremendous payouts are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that tracking will be uninterrupted or error-free; where tracking fails through no fault of yours, our sole obligation is to make a good-faith determination of attribution under Section 4.
17. Limitation of liability
To the fullest extent permitted by law: (a) eskiin and its officers, directors, employees, agents, and service providers (including Social Snowball and Tremendous) will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, or lost profits or revenues, arising out of or relating to the Program; and (b) eskiin’s total aggregate liability arising out of or relating to the Program will not exceed the greater of (i) the amounts paid to you under the Program in the 12 months before the event giving rise to the claim, or (ii) $100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
18. Indemnification
You will indemnify, defend, and hold harmless eskiin and its officers, directors, employees, agents, and service providers from and against any claims, damages, penalties, fines, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your breach of these Terms; (b) content you create or share; (c) messages you send, including any alleged violation of CAN-SPAM, the TCPA, or state messaging laws; (d) untruthful, misleading, or health-related claims you make about eskiin products; (e) your failure to make required disclosures; and (f) your violation of any law or the rights of any third party.
19. Governing law and dispute resolution
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles, consistent with Section 18 of our Terms of Service.
Any dispute, claim, or controversy arising out of or relating to the Program or these Terms (a "Dispute") is governed by Section 22 of our Terms of Service (Dispute Resolution; Binding Arbitration; Class Action Waiver), which is incorporated into these Terms by reference and applies to Program Disputes as if fully set out here. AMONG OTHER THINGS, SECTION 22 REQUIRES THAT MOST DISPUTES BE RESOLVED THROUGH FINAL AND BINDING INDIVIDUAL ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION RATHER THAN IN COURT, WAIVES YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN ANY CLASS OR REPRESENTATIVE PROCEEDING, requires a signed Notice of Dispute and a 60-day informal resolution period before arbitration may be commenced, excludes small-claims court actions and intellectual-property injunction actions, includes procedures for mass arbitrations, and gives you the right to opt out within 30 days. Please read it carefully at eskiin.com/policies/terms-of-service.
For purposes of the Program, the 30-day opt-out period in Section 22 runs from the earliest of the date you first accept these Terms, the date you first accept the Terms of Service, or the date of your first eskiin purchase, and a valid opt-out under Section 22 applies equally to Program Disputes. Nothing in Section 1 of these Terms displaces Section 22, which controls dispute resolution for the Program.
Any claim arising out of or relating to the Program must be brought within one (1) year after the claim accrues, or it is permanently barred, to the extent permitted by law. This limitation period is tolled during the informal resolution process required by Section 22.
20. General terms
- Entire agreement (Program). These Terms, together with the documents they incorporate, are the entire agreement between you and eskiin regarding the Program and supersede all prior referral or affiliate terms and summaries, including the page terms dated August 8, 2026, the draft affiliate terms dated August 14, 2026, and any summary or draft terms displayed on the Refer and Earn page.
- Severability. If any provision is held unenforceable, it will be enforced to the maximum extent permissible and the remainder will remain in effect.
- No waiver. Our failure to enforce any provision is not a waiver of it.
- Assignment. You may not assign or transfer your participation or any reward; we may assign these Terms in connection with a merger, acquisition, or sale of assets.
- Notices. We may give notice through the Social Snowball dashboard or to the email address on your account. Notices to eskiin go to support@eskiin.com or eskiin Inc., 9450 Southwest Gemini Drive, Beaverton, Oregon 97008.
- Survival. Provisions that by their nature should survive (including taxes, licenses, recovery rights, disclaimers, liability limits, indemnity, and dispute resolution) survive termination.
